1. Agreement to these terms

These Terms & Conditions govern your use of wiscomed.com and, where accepted, the supply of goods by WiscoMed Supply Co., a business owned and operated by Matthew Clayton at 54 Horseshoe Lane, Philadelphia, PA 19103, United States. By using this website or placing an order with us, you agree to these terms. If you do not agree, please do not use the site.

2. Who may buy from us

We supply licensed healthcare practices, care facilities, first-response organisations, schools, public bodies and businesses. We do not sell to private consumers. Certain products may require evidence of professional licensure before we release them. We reserve the right to decline or cancel any order where eligibility cannot be verified.

We do not supply prescription medicines or controlled substances of any kind.

3. Quotations and pricing

Written quotations are valid for 30 days unless stated otherwise on the quotation itself. Prices displayed anywhere on this website are indicative ranges for illustration and do not constitute an offer. Manufacturer price increases, tariff changes and freight surcharges may require a quotation to be revised before acceptance; we will always tell you before an order is processed at a changed price.

All prices are exclusive of applicable sales tax. Tax-exempt customers must provide a valid exemption or resale certificate before their first invoice.

4. Orders and acceptance

An order becomes binding when we issue a written order confirmation. We may decline an order where stock is unavailable, where credit terms are not met, where an obvious pricing error has occurred, or where the intended use appears unlawful. Order changes or cancellations must reach us before the order is picked; once picked, our returns terms apply.

5. Payment terms

New accounts pay by card or ACH on their first three orders. Net-30 terms may be granted after a credit review. Invoices unpaid after 30 days may attract interest at 1.5% per month or the maximum permitted by Pennsylvania law, whichever is lower, plus reasonable collection costs. We may suspend deliveries on overdue accounts after written notice.

This website does not process payments and does not collect card numbers.

6. Delivery, title and risk

Delivery estimates are made in good faith and are not guaranteed. Risk in goods passes to you on delivery to the address you nominate, or to your nominated carrier where you arrange collection. Title passes when the invoice is paid in full. Shortages or visible damage should be noted on the delivery paperwork and reported within five business days. 7. Product information and clinical responsibility

Descriptions, images, specifications and comparisons on this website are provided for procurement purposes and may be updated by manufacturers without notice. They are not medical advice and are not a substitute for the manufacturer’s instructions for use.

You are responsible for confirming that a product is suitable and lawful for its intended clinical or occupational use, that your staff are trained in its use, and that use complies with your organisation’s protocols and applicable regulation.

8. Warranties

Goods carry the warranty offered by their manufacturer, and we will pass through and assist with any manufacturer warranty claim. Except where prohibited by law, and except for our obligations regarding defective or mis-shipped goods, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to any order is limited to the amount paid for the goods giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or business interruption. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.

10. Recalls and safety notices

Where a manufacturer or regulator issues a recall or field-safety notice affecting a lot we have supplied to you, we will notify your named account contact by email and telephone, and will coordinate return, quarantine or replacement in line with the manufacturer’s instructions. You agree to act promptly on such notices and to maintain records adequate to identify affected stock.

11. Acceptable use of this website

You may not use this website to transmit unlawful, infringing or harmful material; attempt to gain unauthorised access to our systems; scrape or bulk-copy content for a competing catalog; or interfere with the operation of the site. We may suspend access where we reasonably believe these terms have been breached.

12. Intellectual property

The design, text, photography, structure and code of this website are owned by WiscoMed Supply Co. or used under licence. Manufacturer names, brands and product images remain the property of their respective owners and appear here for identification purposes only. You may print or download pages for your internal procurement use; any other reproduction requires our written permission.

13. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including manufacturer allocation, transport disruption, severe weather, industrial action, public-health emergency, utility or network failure, or acts of government.

14. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. The state and federal courts located in Philadelphia County, Pennsylvania have exclusive jurisdiction, and both parties submit to that jurisdiction. Before commencing proceedings, both parties agree to attempt resolution in good faith by telephone or in person for at least 30 days.

15. Severability and changes

If any provision is found unenforceable, the remainder continues in force. We may amend these terms; the version in effect at the time your order is confirmed governs that order. The current version is always published on this page with its effective date.
